What is Collaborative Divorce? Collaborative Divorce is an innovative approach where a couple agrees in writing to dissolve their marriage with respect, dignity and honesty. These divorces often resolve more quickly than traditional divorce litigation and for a fraction of the cost. Couples also benefit from the use of trained professionals such as attorneys, financial and child specialists and therapists to reach the best settlement that meets the needs of all involved.

Besides the time and financial benefit of collaborative divorce, the primary benefit is that participants avoid the trauma, character assassination and humiliation that take place during most traditionally-litigated divorces. The collaborative process seeks to preserve relationships. This is done with the idea that most divorces involve children and couples must co-parent for many years after a divorce is done.

This method of divorce was started by a family law litigator, Stu Webb, about a decade ago. Mr. Webb was tired of seeing how families were destroyed and resources depleted after “scorched earth” litigation. Back then, divorcing couples only had two options, doing it themselves or do it through litigation, which inevitably led to years of fighting, court appearances, stress, trauma and financial devastation.

Since then, collaborative divorce has spread like wildfire and more and more, couples are choosing collaborative divorce. These couples are spending a fraction of the money they normally would on a traditional litigation as well as a fraction of the time. They are saving time and money, but most importantly, through the help of trained professionals and divorce coaches, they are preserving relationships for the years after a divorce enabling them to effectively co-parent. They are also protecting their children from the bloodbath that is family litigation while having the protection, and advice of their own attorney.

It is estimated that internationally over 20,000 professionals have received training in collaborative divorce. Erin states, “This is definitely not a flash in the pan type of divorce. It is here to stay and hopefully grow and grow. Locally, we are training ourselves every chance we get and have been trained by one of the best, Pauline Tesler, a leader in the international collaborative movement. Donna Brazile to Speak at Walden University Academic Residency in Dallas

Donna Brazile, the nationally acclaimed political strategist and commentator and chair of the Voting Rights Institute, will deliver an address titled “The Political Environment and Mood of the Country” at Walden University’s winter academic residency. The event will take place on Thursday, January 22 at 1:00 p.m. at the Sheraton Dallas Hotel.

Brazile’s plenary address will touch on her breadth of political experience, which includes running the Gore/Lieberman campaign in 2000 and serving as chief of staff and press secretary to Congresswoman Eleanor Holmes Norton, D-D.C. She will also offer an overview of the political environment and discuss trends shaping and driving the mood of the country.

Brazile has worked on every presidential campaign since 1984, making history in 2000 as the first African American to lead a major presidential campaign. After the Gore-Lieberman campaign, she was appointed chair of the Democratic National Committee’s Voting Rights Institute, an organization established in 2001 to help protect and promote the rights of all Americans to participate in the political process.

Author of Groundbreaking Caregiver’s Book to Speak at Cambridge Credit Counseling’s July Community Seminar

The current economic downturn has forced many Americans to make substantial changes in their lifestyle. Across the country, families are dealing with the crisis of foreclosure, rapidly increasing unemployment, and a general lack of confidence in the economy’s ability to rebound. As life within the country becomes more challenging, perhaps the group most adversely affected is the elderly. Over the last two years, there’s been an increase in the number of elderly parents moving back in with their children, very likely out of economic necessity. Until now, there were very few resources to assist individuals who were thrust into the position of caregiver for their aging parents.

The recently released When Your Parent Moves In; Every Adult Child’s Guide to Living with an Aging Parent, written by David Horgan and Shira Block, is a book that addresses these issues head on. Through a series of personal stories, case studies and expert analysis, the book provides individuals with strategies they can use to make a successful transition to living with one’s parents. Among the topics discussed are the pros and cons of having an aging parent move in, the possible pitfalls of such a change and how to avoid them, adjusting the family dynamic, and most important, how to manage and protect everyone’s assets.

New Federal Regulation Targeting Tax Debt Resolution Companies: The Consumer Financial Protection Bureau (CFPB) and the Financial Fraud Enforcement Taskforce

On June 23, 2011 the Bureau of Consumer Financial Protection (CFPB) issued its Federal Register Notice for defining “larger” non-depository industry participants. The Notice outlined the industries that the Bureau will immediately seek to regulate.

One of the industries to be regulated is “debt relief services” which includes providers of services that “offer to reduce medical or tax debt.”

The newly created Consumer Protection Working Group of the federal Financial Fraud Enforcement Taskforce has stated that it will work across federal law enforcement and regulatory agencies, and with state and local partners, to strengthen efforts to address consumer issues, including schemes targeting vulnerable populations, such as the unemployed, those in need of payday loans, and those suffering from the burden of high credit card and other debt.

The Future of Deferred Enforcement of the Federal Trade Commissions Telemarketing Sales Rule

On October 17, 2010 the Telemarketing Sales Rule (TSR) became effective thus regulating “debt relief services” which included individual or companies that negotiate or settle “tax debts owed to the government.”

The same day the TSR became effective, the Federal Trade Commission (FTC) issued a policy statement that it was unclear if tax debts are “unsecured” one of the triggering elements of the TSR. In this session you will learn the history and current status of the treatment of tax debt in the TSR and the FTCs work to regulate the industry.

Continuing Education Requirements and Compliance Solutions

Enrolled agents, certified public accountants, attorneys, registered tax return preparers all have differing requirements for continuing education and compliance. This session will review the current “what” you have to do as well as provide the “how” to remain compliant to represent taxpayers before the IRS.

The Congressional football of jurisdiction over tax debt resolution companies and their IRS approved employees is being bounced around from Committee to Committee with each claiming some part of the industry but not the industry as a whole.
