San Diego Attorney Awarded Top Honors for Groundbreaking Work in Civil Rights Case Against Orange County Social Services Agency

On November 2, 2007, the Orange County Trial Lawyers Association awarded a San Diego attorney top honors in electing him as the “Top Gun – Trial Attorney of The Year” in the area of civil rights. The award was based on the 4.9 million dollar jury verdict obtained by Deanna Fogarty-Hardwick, against Orange County, its Social Services Agency, and two of its social workers Marcia Vreeken and Helen Dwojak earlier this year in a lawsuit alleging violations of her Constitutional right to familial association.

This case (Fogarty-Hardwick v. County of Orange, et al.; Superior Court of California, County of Orange; Case No. 01CC02379; Trial before Hon. Ronald L. Bauer, Dept. CX103) was brought by Deanna Fogarty against the County of Orange, Marcia Vreeken, Elaine Wilkins, and their supervisor Helen Dwojak to recover damages arising from Defendants alleged falsification of evidence, perjury, and suppression of exculpatory evidence during a juvenile dependency action back in February of 2000. On March 23, 2007 after over six years of litigation and a seven week trial, an Orange County Jury found against Orange County, social worker Marcia Vreeken, and social worker supervisor Helen Dwojak and awarded monetary damages of $ 4.9 million. A third social worker, Elaine Wilkins was found not liable.

In addition to seeking damages, Ms. Fogarty also sought to enjoin the Orange County Social Services Agency from continuing its allegedly unlawful practice of making allegations of wrong doing against parents in dependency proceedings without supporting evidence. On May 14, 2007 Orange County Superior Court Judge, Ronald Bauer (Dept. CX-103) issued an injunction against the Orange County Social Services Agency requiring the agency to obtain “reasonable and articulable evidence” prior to initiating dependency proceedings alleging abuse, neglect, or abandonment of a child.

eGuardian Joins Forces with FoundationCare to Help Orange County Schools

eGuardian, designers of the child-safe Internet, today announced a partnership with FoundationCare, a non-profit organization dedicated to helping schools fund new technology, that will expand the reach of eGuardian and provide schools with a new income source.

The partnership between eGuardian and FoundationCare will be heralded in a promotional campaign on the family-friendly cable networks Oxygen, Nickelodeon, the Food Network and ABC Family. “We look forward to increasing awareness of this exciting new partnership among California’s parents, teachers and school administrators. With help from eGuardian and FoundationCare, Orange County schools can lead the way in Internet protection, and benefit financially as well,” Zayas said.

The eGuardian application, which runs on any Windows- or Mac-based computer, verifies the age of a child and blocks contact with predators by allowing children to interact online only with other eGuardian-verified children. The service also blocks pornography sites, and allows popular search engines to automatically filter search results for the age of the child visitor.

eGuardian is available for a one-time fee of $ 20. Special programs are available to waive the fee for low-income households. Schools that choose to participate directly in eGuardian registration can earn more money per enrollment, and receive free unlimited use of the service for protecting children on school computers.

Stephen D. Klarich, Respected Orange County Criminal Defense Attorney and Partner of Wallin & Klarich, Assists Client to No Longer be Required to Register as Sex Offender

A Wallin & Klarich client is no longer required to register as a sex offender after being issued a Certificate of Rehabilitation for a prior conviction for indecent exposure in Orange County, California. The client was represented by top Orange County criminal lawyer, Stephen D. Klarich, of Wallin & Klarich.

After living in the shadows as a sex offender registrant for the past 13 years, our client is relieved from the stigma of having to register as a sex offender for the rest of his life and can now have the respect and trust of the community. He can now focus on his wife and on his family, said Mr. Klarich.

According to court record from Orange County Superior Court Central Justice Center, the client was convicted in 1999 for indecent exposure, a misdemeanor in Orange County under California Penal Code section 314.1. As a result of the indecent exposure conviction, the client was placed on probation for three years, ordered to pay fines, and was required to complete 40 days of community service. In addition, the client was also required to register as sex offender with law enforcement pursuant to California Penal Code section 290.

Prior to seeking the help of Wallin & Klarich, the client had been registering as a sex offender for 13 years and would have been required to register for the rest of his life. After the client contacted Wallin & Klarich, Mr. Klarich referred the client to an experienced clinical and forensic psychologist. The psychologist evaluated the client and determined that he had been rehabilitated and did not pose any threat of committing a sex offense. Mr. Klarich presented the psychologists report and other vital information that showed the client had been rehabilitated in the form of a petition for a Certificate of Rehabilitation, which was filed with the Orange County Superior Court.

After the petition was filed, a hearing was held. At the hearing, Mr. Klarich presented the evidence and information that showed the client was completely rehabilitated and should not be required to register as a sex offender for the duration of his life. The court ultimately favored Mr. Klarich and the client, and issued a Certificate of Rehabilitation. As a result, the client no longer is required to register as a sex offender pursuant to California Penal Code section 290. The client is also able to obtain employment that he previously had been prevented from because of his sex offender status and no longer carries the burden of being labeled a sex offender throughout the community.

Experienced Wallin & Klarich defense attorney Christopher Lee, recently assisted his client who had been charged with vandalism under California Penal Code section 594, to avoid a criminal conviction and jail time. The client also was able to retain his drivers license and driving privileges.

A vandalism conviction is serious, as it can result in a one year license suspension by the Department of Motor Vehicles (DMV). It is important to find an attorney who can negotiate with the District Attorney to offer a reduced charge or plea bargain for the vandalism charge, so that your drivers license is not at risk, said Mr. Lee.

According to court record from Orange County Superior Court, the client was arrested and charged with vandalism after he purchase eggs at the grocery store and later threw all of the eggs at another persons house. As a result of the vandalism charges the client faced a sentence of up to one year in the county jail and $ 1000 in fines. The client also faced the possibility of having his drivers license suspended for up to two years.

The client sought out the help of Wallin & Klarich vandalism defense attorney, Christopher Lee according to court documents. Mr. Lee explained to the client his options given the circumstances and described the complicated legal system. First, Mr. Lee talked to the judge about recommending to the District Attorney that the client receive a deferred entry of judgment offer. A deferred entry of judgment would prevent the client from having any criminal conviction related to the vandalism charge on his record and to avoid the severe penalties of his vandalism charge.

The District Attorney initially declined to offer a deferred entry of judgment option to the client. However, after Mr. Lee and the client agreed to compensate the owner of the home for any damages that were caused by the egg throwing, the District Attorney agreed to offer the client the option of a deferred entry of judgment according to court record. As a result of the deferred entry of judgment offer, the client was able to avoid imprisonment and did not have his drivers license suspended. Instead the client was only required to complete community service. A deferred entry judgment also prevented the client from having any criminal conviction on his record that could follow him for years to come.

Court of Appeal Affirms Orange County Jury Finding Cps Liable to Mother for $ 4.9 Million in Damages.

On March 23, 2007, the Orange County Social Services Agency and two of its Social Workers, Marcie Vreeken and Helen Dwojak were found liable for violating the parental rights of Deanna Fogarty-Hardwick, as guaranteed under the Fourth and Fourteenth Amendments to the United States Constitution. The jury found in favor of Ms. Fogarty-Hardwick and awarded $ 4.9 million in economic and non-economic damages, and approximately $ 6,000 in punitive damages against the individual social workers.

At trial, Ms. Fogarty-Hardwick demonstrated that social workers Marcie Vreeken and Helen Dwojak caused Ms. Fogarty-Hardwick’s children to be removed from her custody without cause, and continued to detain them without cause, violating Ms. Fogarty-Harwick’s Constitutional right to familial association. Ms. Fogarty-Hardwick demonstrated that these defendants, while working as social workers for Orange County Social Services, intentionally fabricated evidence to obtain a court order to detain Ms. Fogarty-Hardwick’s two young daughters on February 17, 2000. Ms. Fogarty-Hardwick also demonstrated that Orange County Social Services, Marcie Vreeken and Helen Dwojak maliciously failed to provide the court with exculpatory information, and filed false reports in furtherance of the effort to keep Ms. Fogarty-Hardwick separated from her children.

The lawsuit also alleged that the policies, practices, or procedures employed by Orange County Social Services and the County of Orange in the removal of Plaintiff’s children from her care also violated Ms. Fogarty-Harwick’s constitutional rights, under the Fourth and Fourteenth Amendments to the United States Constitution. The unlawful policies, practices or procedures pertained to the detention of children without a finding of imminent danger or serious physical injury; interviewing children without a parent present; continuing detention after learning there was no basis to do so; using trickery and fabricated evidence; and failing to adequately train employees regarding the Constitutional rights of parents.

In addition to the jurys verdict, the trial court also awarded attorneys fees of $ 1,653,284.95.

The defendants Orange County, Marcie Vreeken and Helen Dwojak, all appealed the jury verdict, the courts decision, and the attorney fee award. On June 14, 2010, after in depth review of extensive briefs and a complex record, Division Three of the Fourth District Court of Appeal for the State of California issued its opinion affirming the Orange County jurys verdict awarding Deanna Fogarty-Hardwick approximately $ 4.9 million against the County of Orange, and two of its social workers, and affirming the trial court decision awarding attorneys fees.

In its opinion, the Court of Appeal voiced its concerns over what happened to Ms. Fogarty-Hardwick: Stated plainly, the outcome of this case cannot be dismissed as merely the unfortunate product of a runaway jury. The evidence adduced at trial obviously caused both the jury and the judge to conclude not only that something seriously wrong was done to Fogarty-Hardwick in this case, but also that the wrongful conduct was not an isolated incident. That conclusion is something the County should be taking very seriously.

CPS Insurance Services Secures $25K Grant For Orange County Foundation For Oncology Children And Families

CPS Insurance Services (CPS) recently secured a $ 25K grant from the National Association of Independent Life Brokerage Agencies(NAILBA) to support the Orange County Foundation for Oncology Children and Families (OCF-OCF). The grant will be used to help fund the organizations weekend camps held every June and September for children battling cancer and their families.

The OCF-OCF was established in 1982 and has remained a non-profit, volunteer run organization providing free of charge, year-round recreational and social activities designed to foster supportive relationships for pediatric cancer patients and their families.

This grant allows us to host our camp for families in the Orange County area, said Neil Barbour, past Executive Director and current board member of OCF-OCF. Our ultimate goal is to give families the opportunity to have an enjoyable experience outside of the hospital and to foster relationships with others in the same boat in order to gain strength and support.

OCF-OCFs weekend getaway is deemed the Worlds Greatest Camp and is hosted in Big Bear, CA. It provides an opportunity for children and families facing the stress of cancer to unwind. Campers have the opportunity to participate in activities such as horseback riding, archery, crafts, swimming, lake activities, a campfire and a ropes challenge course.

The NAILBA Charitable Foundation supports recognized charities that serve the needs of children in the US. The funds that are donated are collected from the 350 member agencies, like CPS Insurance Services, through donations and silent live auctions. In its nearly 10 years in existence, the NAILBA Charitable Foundation has given away more than a million dollars.
