New Orleans Criminal Defense Lawyer Elizabeth Carpenter Speaks at the NOPA Annual Educational Seminar on Cyber Crimes

New Orleans criminal defense attorney Elizabeth Carpenter spoke last Friday in a session titled Cyber Crimes: Digital Forensics and Defense at the Annual Education Seminar in New Orleans, a continuing education seminar organized by the New Orleans Paralegal Association (NOPA).

Sex crimes defense requires a very specific defense strategy backed by extensive investigation and trial preparationsomething that not all defense attorneys have a background for. NOPA asked Carpenter to speak at their Annual Education Seminar because she has undergone training in Forensics and DNA Evidence at the National Institute of Justice and the DNA Initiative Project, and because she has extensive experience as a New Orleans child pornography defense attorney and cyber crimes attorney.

Not all defense attorneys are willing or equipped to defend Internet crimes, explained Carpenter. To form an Internet crimes defense in New Orleans, your attorney has to be familiar with the technology in question. If youre arrested or served with a search warrant for child pornography or other cyber crimes, a computer forensic technician will go through the hard drive of your computer and write up a forensic report. If your attorney doesnt know how to read the more technical parts of those reports, they wont be able to form a strong defense.

The penalties for cyber crime offenses in Louisiana are severe. The sentencing guidelines for even a first-time offender require a mandatory minimum sentence of 2 years and a possible maximum of 10 years without parole per count, along with a fine of up to $ 10,000. Furthermore, anyone convicted of a child pornography-related cyber crime must register as a sex offender, a requirement that can lead to loss of employment, estrangement from family, and even difficulty finding housing.

A cyber crime charge is not something that is easy to face, said Carpenter, both because of the technical aspects of cases such as these and because of the stigma attached to Internet crimes. Its important to have someone representing you who is familiar with the procedures involved, and its also important to have an attorney who is on your side. My job as a cyber crimes defense attorney isnt to judge youits to use my experience to protect your rights and preserve your freedom.

Stephen D. Klarich, Respected Orange County Criminal Defense Attorney and Partner of Wallin & Klarich, Assists Client to No Longer be Required to Register as Sex Offender

A Wallin & Klarich client is no longer required to register as a sex offender after being issued a Certificate of Rehabilitation for a prior conviction for indecent exposure in Orange County, California. The client was represented by top Orange County criminal lawyer, Stephen D. Klarich, of Wallin & Klarich.

After living in the shadows as a sex offender registrant for the past 13 years, our client is relieved from the stigma of having to register as a sex offender for the rest of his life and can now have the respect and trust of the community. He can now focus on his wife and on his family, said Mr. Klarich.

According to court record from Orange County Superior Court Central Justice Center, the client was convicted in 1999 for indecent exposure, a misdemeanor in Orange County under California Penal Code section 314.1. As a result of the indecent exposure conviction, the client was placed on probation for three years, ordered to pay fines, and was required to complete 40 days of community service. In addition, the client was also required to register as sex offender with law enforcement pursuant to California Penal Code section 290.

Prior to seeking the help of Wallin & Klarich, the client had been registering as a sex offender for 13 years and would have been required to register for the rest of his life. After the client contacted Wallin & Klarich, Mr. Klarich referred the client to an experienced clinical and forensic psychologist. The psychologist evaluated the client and determined that he had been rehabilitated and did not pose any threat of committing a sex offense. Mr. Klarich presented the psychologists report and other vital information that showed the client had been rehabilitated in the form of a petition for a Certificate of Rehabilitation, which was filed with the Orange County Superior Court.

After the petition was filed, a hearing was held. At the hearing, Mr. Klarich presented the evidence and information that showed the client was completely rehabilitated and should not be required to register as a sex offender for the duration of his life. The court ultimately favored Mr. Klarich and the client, and issued a Certificate of Rehabilitation. As a result, the client no longer is required to register as a sex offender pursuant to California Penal Code section 290. The client is also able to obtain employment that he previously had been prevented from because of his sex offender status and no longer carries the burden of being labeled a sex offender throughout the community.

According to court record from the Superior Court of Los Angeles – West Covina, the client was arrested for a DUI causing injury after being involved in a hit and run. The client faced a maximum sentence of six years imprisonment in the county jail. In addition to jail time, the client faced a minimum of a one year license suspension and loss of his driving privileges. Instead of posting bail, the client decided to contact Wallin & Klarich for assistance. Mr. Moffatt, who has years of experience successfully defending clients in DUI cases, quickly responded to the clients requests and set up a meeting with the client while he was in custody.

Mr. Moffatt contacted and negotiated with the District Attorney, who instead of charging the client with a felony for DUI causing injury, opted to charge the client with three misdemeanors according to court documents. The misdemeanor charges carried a much lesser sentence than a felony charge for a DUI causing injury. As a result, the client ended up having his sentence reduced to only 10 days of community service. The client did not have to pay any fine and avoided any order for jail time. In addition, the client was able to have a restricted license returned to him within one month, rather than having to suffer the loss of his driving privileges for an entire year. After the hearing at the Superior Court of Los Angeles, West Covina, the client was released from custody. The client has been able to return to work so he could support his family.

Criminal Defense Attorney, Christopher Lee of Wallin & Klarich, Assists Client to Avoid Jail Time by Getting Sentence for Charges of Possession of a Deadly Weapon Reduced

A Wallin & Klarich client, who was charged with possession of a deadly weapon, recently had his sentence reduced to community service instead of jail time. The client was represented by knowledgeable and experienced Orange County criminal lawyer, Christopher Lee.

My client was at the wrong place at the wrong time, said Mr. Lee. I negotiated with the prosecution and convinced them that there is a distinction between a person possessing a deadly weapon ready to do harm or evil and a person maintaining a weapon for self defense.

According to court record from Orange County Superior Court Central Justice Center, the incident began when the client fell asleep in his car in the parking lot of his place of employment. The client had a substantial commute and in order to get to work on time and avoid traffic would many times arrive early to work and rest in his car prior to his work shift. After noticing that the client was asleep in a parked car, a worried nearby neighbor called the police claiming there was a suspicious vehicle and possible burglar in the area. When the police arrived to investigate the claims made by the neighbors call, they searched the interior of the clients vehicle and found a collapsible baton. Consequently, the client was arrested and taken into custody for possession of a deadly weapon.

After being charged with possession of a deadly weapon the client faced a maximum sentence of one year in the county jail and $ 1,000 in fines according to court documents. In addition to the maximum sentence, the client faced a mandatory sentence of 60 days in the county jail. Attorney Christopher Lee, committed to earning the best possible outcome for the client in the case, quickly gathered information related to a defense. Mr. Lee provided the District Attorney with the full facts of the case and presented evidence that the client kept the baton in his car in case he needed it for his own protection. Mr. Lee also provided evidence that this was a reasonable concern for the client, as the clients home had recently been broken into on two separate occasions.

After negotiating with Mr. Lee and learning the behind the scenes facts of the case, the District Attorney offered community service labor as the sentence for the charges against the client according to court record. As a result, the client was able to avoid spending at least 60 days in the county jail and was only required to complete 24 hours, or three days of community service labor.
